Terms of Service
These Terms of Service ("Terms") govern your access to and use of software, updates, content, and related services provided by win_dev_ger ("we", "us", or "our"). By downloading, installing, or using our software, you agree to these Terms. If you do not agree, do not use the software or related services.
1. Eligibility
You may use our services only if you are legally able to enter into a binding agreement under the laws that apply to you. If you use them on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. License Grant
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use our software for its intended personal or internal business purpose. This license does not transfer ownership of the software or any intellectual property rights to you.

4. Support Communications
Some features may require communication with us or a distribution platform. If you contact us, you agree to provide accurate information and not to send unlawful, harmful, abusive, or infringing content.
5. Software Updates
Our software may receive patches, fixes, compatibility improvements, content updates, or other modifications. Updates may be provided automatically or through a distribution platform and may be required for continued functionality, security, or compatibility.
6. Third-Party Distribution Platforms
Our software may be distributed through third-party platforms. Your use of those platforms may also be governed by separate terms, billing rules, device requirements, refund rules, subscription rules, and technical policies. We are not responsible for third-party platform operations, outages, or policy changes.
7. Paid Features, Purchases, and Subscriptions
Some software or features may be offered for a one-time fee, by subscription, or with optional paid upgrades. Where subscriptions are offered:
- pricing, billing frequency, trial availability, and renewal terms will be shown through the relevant purchase process or distribution platform;
- subscriptions may renew automatically unless canceled using the applicable subscription management tools;
- you are responsible for reviewing the applicable pricing and renewal terms before purchase; and
- refunds, if any, are generally handled under the applicable distribution platform's policies, subject to rights provided by law.
8. Intellectual Property
All rights, title, and interest in our software, designs, logos, text, graphics, and other content remain the property of win_dev_ger or its licensors. Except for the limited license expressly granted in these Terms, no rights are granted to you by implication or otherwise.
9. Third-Party Content and Services
Our software may reference, integrate with, or link to third-party services, tools, or content. We do not control those third parties and are not responsible for their availability, accuracy, policies, or content. Your interactions with them are between you and the relevant third party.

11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our software and related services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, complete security, compatibility with every device or configuration, or correction of every defect. To the extent permitted by law, we disclaim express, implied, and statutory warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, win_dev_ger and its personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, revenue, business opportunity, or device functionality arising from your use of, or inability to use, our software or related services.
If liability cannot be excluded but may lawfully be limited, our total liability will be limited to the amount you paid, if any, for the relevant product or service during the twelve months before the event giving rise to the claim. This section does not limit liability or remedies that cannot lawfully be limited.
13. Termination
We may suspend, restrict, or terminate access to all or part of our services if you violate these Terms, if we must do so for legal, security, or technical reasons, or if continued operation is no longer reasonably possible. We will provide notice where required by law. You may stop using our software at any time by uninstalling it and discontinuing use.
Provisions that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, applicable law, and dispute provisions.
14. Changes to the Services
We may modify, suspend, replace, or discontinue software or features. We are not obligated to maintain a particular feature, version, or functionality for a specific period unless required by law.
15. Changes to These Terms
We may update these Terms from time to time and revise the effective date above. We will seek any form of notice or consent required by applicable law. Your continued use after updated Terms take effect may indicate acceptance where permitted by law.
16. Applicable Law and Disputes
Disputes relating to these Terms or our services may be brought before a court that has jurisdiction under applicable law. Nothing in this section limits mandatory consumer protection rights or legal remedies.
